Tonight ABC's 20/20 will take a look at the case of a cruise passenger who fell from her balcony, struck a lifeboat below her, and then plunged into the water.
Although her fall was captured on the cruise ship's surveillance cameras, the ship sailed on. That's because Carnival did not have an automatic man overboard system in place to notify the bridge that a person went overboard.
The camera which recorded the passenger going overboard was not monitored by a cruise ship employee, nor was it tied to an alarm system of any type.
It took an hour and one-half for the cruise line to figure out what happened and turn around and rescue the young woman. The fact that she was still alive is a miracle.
I do not represent this woman although I was interviewed during the program, which you can see a portion of from this morning's Good Morning America program.
Some people may say that it was the woman's fault for drinking too much and she's to blame for falling overboard. A jury can apportion fault to both the passenger and the cruise line. Cruise lines in our jurisdiction have legal liability when they over-serve alcohol to passengers. Selling booze is a major money maker for cruise lines. Cruise lines don't make money selling cruise tickets. The big money comes from "onboard purchases," like excursions, gift shop purchases, casino gambling and, number one profit center, pushing alcohol sales.
But the story is not just about who's to blame for the alcohol and the fall overboard.

The cruise lines have come up with a boat load of excuses why they have not complied with the law, like the technology doesn't exist, or it's inaccurate and unreliable, or its just too expensive.
But there is no question the technology exists. My belief is that the cruise lines simply don't want to spend the money.
The systems are required irrespective of why a person goes overboard. If they are drunk, or acting irresponsibly, or they fall by accident, or they want to commit suicide, or they are thrown overboard, it doesn't matter. The cruise lines must have the systems in place.
The vast majority of cruise ships don't.

It appears that the recent rash of cruise ship overboards is not going to end anytime soon. We have been reporting on numerous people going overboard from cruise ships over the past month an a half, with at least 4 people being killed or lost at sea after falling from a cruise ship. Saturday, a woman reportedly jumped from a cruise ship, but unlike other recent overboards, she was rescued alive.
A 29 year old woman, who has not been identified, reportedly jumped from the Carnival Destiny on Saturday. The ship had left the Port of Miami when the woman was witnessed jumping from the ship by fellow passengers. The ship immediately began search and rescue operations, and the woman was found and rescued.
The woman was given treatment aboard the ship in the ship's infirmary. Medics aboard the ship determined the woman would need further treatment. Instead of following its planned itinerary, and heading to Ocho Rios, Jamaica, the ship diverted to Key West, Florida. There has been no explanation given as to why the woman jumped from the ship.
This latest cruise ship overboard has had a relatively happy ending. In the past month and a half, we have reported on 4 additional cruise ship overboards, all of which resulting in the missing person being found dead, or declared lost at sea.

Video footage from the Carnival cruise ship where a young couple went missing this week appears to show the woman jumping from the vessel and her panic-stricken boyfriend following moments later, Australia's Herald Sun is reporting .
The news outlet, citing local police, says an enhancement of security video from the Australia-based Carnival Spirit appears to show Paul Rossington, 30, jumping after his girlfriend, Kristen Schroder, 27, about 20 seconds after she plunged from the ship.
The couple went overboard late Wednesday as the Carnival Spirit was sailing off the coast of Australia, but no one realized they were missing until Thursday morning when the vessel docked in Sydney.
A massive air and sea search of the waters off the Australia coast begun on Thursday was called off today, and the couple is presumed dead.
The Herald Sun says detectives have spent the last day enhancing and analyzing surveillance footage from the ship to figure out what happened to the couple, who were traveling with friends and family.
In a statement sent to USA TODAY on Thursday, Carnival was vague about what the security camera footage showed but ruled out anything criminal.
"There is indication from the shipboard video of what transpired," the statement says. "There is no evidence of foul play. However, out of respect for the families, we are not going to publicly disclose the details of what occurred at this time."
Carnival's top executive in Australia, Ann Sherry, today defended the Carnival Spirit crew's handling of the situation, the Sydney Morning Herald reports. While the couple's fall from the ship was caught on tape Wednesday by one of the vessel's 600 surveillance cameras, Sherry noted that not all the cameras are monitored around-the-clock.
"We've invested hugely (in cameras), we can see exactly what's going in most parts of the ship at most times," she said, according to the Morning Herald . "There is also a balance, of course, around privacy. We don't watch what people are doing in their private spaces, but we are keen to know exactly what's happening around the sides of the ship."
The incident is just the latest to put Carnival in the spotlight. It comes three months after a power loss on another Carnival ship. the Carnival Triumph, left passengers stranded at sea for days in miserable conditions. The much-publicized event followed an engine room fire on the ship.
Carnival also has experienced power problems in recent months with several other ships, including the Carnival Legend and Carnival Dream, and the line this week has faced complaints about unfinished areas from passengers on the first voyage of the newly revamped Carnival Sunshine.
The 2,124-passenger Carnival Spirit is based in Australia year-round. One of 24 ships at the line, it sails eight - to 12-night voyages to the South Pacific out of Sydney and Melbourne, Australia that are aimed primarily at Australians.
